The first document we hope everyone completes is an advanced healthcare directive, sometimes called a living will. A healthcare directive names a person (agent) who can make decisions about your healthcare when you can’t. It also outlines treatments you do and don’t want performed, and describes your values surrounding quality of life. The best news is that in Minnesota it is free to complete a healthcare directive, and it doesn’t require a lawyer or a notary—signatures from two witnesses make this document legal. Wills and Trusts
When most people think about planning ahead, they think of completing a will or a trust. A will describes how a person’s estate should be settled after death through probate court. Trusts are “buckets” that assets can be placed into to streamline the transfer of ownership after death. However, there’s a lot more to each of these options than that; many aspects of a person’s estate affect which option makes the most sense. Wills and trusts are best completed with an attorney who specializes in estate planning.
